§ 32 Condom requirement

(1) Clients of prostitutes and prostitutes must ensure that condoms are used during sexual intercourse.

(2) The operator of a prostitution trade is obliged to draw attention to the obligation to use a condom in prostitution centres, other premises regularly used for prostitution and prostitution vehicles by means of a clearly visible notice.

(3) It is forbidden to offer, announce or advertise the opportunity for sexual services through the dissemination of writings, sound or image carriers, data storage media, illustrations or representations or to post explanations of such content.

1. Referring to the opportunity to have sexual intercourse without a condom, even if the reference is made in an indirect or concealed form,

2. in a manner which, according to the type of presentation, content or scope or type of carrier medium and its distribution, is suitable for specifically impairing legal interests of the general public in need of protection, in particular the protection of minors,

3. or referring to the opportunity for sexual intercourse with pregnant women, even if the reference is made in an indirect or concealed form. Public exhibiting, posting, demonstrating or otherwise making available to the public is equivalent to dissemination.

On July 1, 2017, the Prostitution Act (Prostituiertenschutzgesetz - ProstSchG) came into force, which regulates the prostitution industry and protects persons engaged in prostitution. For the first time, it covers all typical forms of commercial prostitution and introduces rights and obligations for prostitutes and tradespeople in the field of prostitution.

The law regulates the practice of prostitution by persons over the age of 18 and applies to all sexual services, such as tantra massages or escort. The law also applies to those who do not receive money, but benefits in kind, such as free housing or food, jewellery, etc. for their sexual services, if they secure or increase their livelihood in this way.

It is not decisive whether the sexual services are offered only occasionally or regularly. The law also applies regardless of where the prostitution takes place, whether on the street, in private premises or in a prostitution trade.
